These Terms & Conditions define the standard working practices between Eduard Ferrer Solé (Mountkam) and the Client / Production Company.

 

Services include but are not limited to:

  • Videography
  • Camera Operation
  • Camera Assisting
  • Photography
  • Motion Graphics
  • Editing & Post-Production
  • Colour Grading
  • Photography
  • Digital Content Creation

By confirming a booking, issuing a purchase order, or instructing work to commence, the Client agrees to these Terms & Conditions unless otherwise agreed in writing.

1. Booking & Cancellation

Bookings are accepted subject to availability and may be held as either:

Confirmed Booking
or
Pencil Booking

A pencil booking may be cancelled by either party without charge until confirmed.

A pencil booking becomes automatically confirmed 48 hours before the scheduled workday unless cancelled or renegotiated.

Cancellation Fees

Once a booking is confirmed:

  • More than 48 hours before the booking: 50% of the agreed fee
  • Within 48 hours of the booking: 100% of the agreed fee

Preparation work already carried out (research, equipment preparation, pre-production meetings) may be invoiced separately.


2. Working Day, Overtime & Extended Hours

All bookings are subject to a minimum half-day rate, irrespective of actual time spent on production.

For multi-day productions, any additional hours beyond the agreed working day will be billed at the agreed hourly rate.

 

Standard Working Hours Included in the Day Rate

Production / Shooting Days
Standard production day:
Up to 10 hours (base-to-base)
Including travel, setup, breaks, and lunch

Half-day option:
Up to 5 hours
Half-day bookings are billed at 65% of the full-day rate

Post-Production Days
(editing, motion graphics, colour grading)
Standard post-production day:
Up to 8 hours

Half-day option:
Up to 4.5 hours
Half-day bookings are billed at 65% of the full-day rate

Waiting time for client feedback or materials is counted within working hours if a specific day has been booked in advance.

Overtime

Additional time beyond the standard working hours is billed as overtime at the agreed hourly rate.

Maximum working day:
Production and Shooting days 12 hours, unless otherwise agreed.
Post-Production days 10 hours, unless otherwise agreed.

 

Evening & Weekend Rates

Work outside standard hours may be subject to adjusted rates.

Evenings & Saturdays
1.5× standard rate

Nights, Sundays & Public Holidays
2× standard rate

 

Evening: from 18:00 onward
Night: from 21:00 onward

 

These rates apply in addition to the agreed hourly or day rate.

Weekend or evening work must be agreed in advance.

 

3. Transport & Mileage

Unless otherwise agreed:

  • Transport costs are not included in day rates.
  • Mileage may be charged for travel using personal vehicle.
  • Tolls, parking, and other transport expenses, including as planes, trains or any other kind of transport not paid in advance for the client/production company incurred during production are billed to the client.

Transport arranged by the client/production must meet appropriate safety, comfort, and security standards.

 

4. Equipment & Media

Equipment supplied by Eduard Ferrer Solé is deemed suitable for the project unless otherwise agreed.

Any additional rental equipment sourced on behalf of the Client will be charged accordingly, including pickup and return logistics if applicable.

The standard Filming and Production day rate does include include 1 camera set up but not lighting, equipment or additional cameras which are billed separately.

Equipment Responsibility

The Client is responsible for equipment:

  • Loss
  • Theft
  • Damage
  • Misuse

caused during production by the Client, crew, or associated personnel.

Unauthorized handling of equipment by unqualified personnel is not permitted.

Damaged or lost equipment will be charged at full repair or replacement value.

Media & Data

Recorded media and project files remain the property of Eduard Ferrer Solé until full payment has been received.

Unless otherwise agreed:

  • Project files and raw media are archived for 30 days
  • Extended storage may incur additional costs

Copies of media can be supplied at the cost of storage media and delivery.

 

5. Workplace & Safety

A safe working environment must be maintained at all times.

Eduard Ferrer Solé reserves the right to refuse work in unsafe conditions.

A minimum rest period of 11 hours between working days is required.

Production must inform of any potentially hazardous environments, including but not limited to:

  • Water
  • Sand or dust
  • Extreme weather
  • Chemical or biological hazards
  • Civil unrest or conflict zones

6. Payment & Invoicing

Payment terms:

14 days from invoice date, unless otherwise agreed.

All prices are exclusive of Swiss VAT where applicable.

Late Payments

Late payments may incur default interest of 5% per year in accordance with the Swiss Code of Obligations (Art. 104 CO).

Administrative reminder fees may apply.

Eduard Ferrer Solé reserves the right to withhold delivery of materials or services until payment has been received.

7. Copyright & Usage

Copyright of all recorded material, photography, edits, motion graphics, and final deliverables remains with Eduard Ferrer Solé until full payment has been received.

Upon full payment, the Client receives the agreed usage rights for the specific project.

Unless otherwise agreed:

  • Raw footage
  • Project files
  • Editing timelines

are not included in the standard delivery.

Eduard Ferrer Solé reserves the right to use material from commissioned projects for portfolio, showreel, and promotional purposes, unless confidentiality has been agreed in writing.

The Client is responsible for obtaining permissions for:

  • Performers
  • Locations
  • Trademarks
  • Third-party copyrighted materials.

8. Travel & Accommodation

For productions requiring travel:

The Client is responsible for covering:

  • Transport costs
  • Accommodation
  • Per diems where applicable

Accommodation and transport must meet reasonable safety and comfort standards.

Travel days are considered working days  with a price of 70% day rate when there isn’t involved any shooting or prep unless otherwise agreed.

9. Insurance

Unless agreed otherwise in writing, the Client must ensure appropriate insurance coverage for:

  • Equipment loss or damage
  • Production liabilities
  • Third-party claims

Eduard Ferrer Solé is not responsible for losses incurred by production delays, technical failures, or circumstances beyond reasonable control.

Liability is limited to the value of the booking fee.

10. Foreign Productions

For productions based outside Switzerland:

  • Payment may be required before services commence.
  • Travel costs must be covered in advance.
  • Recorded materials may be withheld until payment is received.

Return travel to Switzerland must be arranged or reimbursed by the production.

11. Governing Law

These Terms & Conditions are governed by the laws of Switzerland.

Any disputes arising from this agreement shall fall under the jurisdiction of the courts of the Canton of Zug, Switzerland.
